Council award the tender for the purchase of a Mowing Tractor to Yurke Sales and Service Ltd. in the amount of $74,800 plus applicable taxes. b) Sidewalk Link between Russell Woods Road and Old Tecumseh Road. It is recommended that: 1. Council approve the construction of a sidewalk between Russell Woods Road and Old Tecumseh Road (along the east side of Elmgrove Drive) as part of the 2017 Elmgrove Phase 2 construction project. c) 2017 Additional Road Works - Silver Creek Industrial Drive and Lakeshore Road #308 It is recommended that: 1. Council approve additional 2017 capital expenditures under the Public Works budget centre for Resurfacing Silver Creek Industrial Drive - Patillo Rd to approximately 300m West at a cost not to exceed $60,000 including net HST; and 2. Approve additional 2017 capital expenditures under the Public Works budget centre for Gravel Road Conversion of Lakeshore Rd#308 from Richardson Sideroad to Gracey Sideroad at a cost not to exceed $250,000 including net HST; and 3. Council award the tender to Rene Blain Trucking Ltd. for the 2017 Supply and Place Gravel program, as per Schedule 1, in the amount of $215,705 plus applicable taxes. 2. Finance Services Report from administration re: a) Ontario Community Infrastructure Fund Top-Up Grant Agreement (OCIF AC3-3190) - West River Street Corridor Project and By-law 22-2017 It is recommended that Council: 1. Authorize Cheryl Horrobin, Director of Finance/Treasurer to sign the grant funding agreement (AC3-3190) with the Ontario Ministry of Agriculture, Food and Rural Affairs (OMAFRA) under the Ontario Community Infrastructure Fund (OCIF) Top-Up Application Component for up to $485,037 in funding toward the West River Street Corridor Project; and 2. Adopt and give three readings to By-law 22-2017, being a By-law to authorize execution of the referenced grant funding agreement; and 3. Community and Development Services Report from administration re: a) Draft Plan of Subdivision, County: File 37-T-07002, Jack Moceri & Sons Contracting Ltd., Location: Part of Lot 1, Concession East of Pike Creek, Community of Maidstone, Town of Lakeshore It is recommended that: 1. The Mayor and Clerk be authorized, by by-law 017 -2017, to execute a Subdivision Agreement with the Owner, subject to the inclusion of the following provision: a. The agreement covers Blocks 1 to 4 of the subdivision for townhouse dwellings and (1) Block for right-of-way conveyance (Block 5) and (3) Blocks for 0.3 metre reserves (Blocks 6, 7 & 8), as shown on Draft Plan of Subdivision 37-T-07002, prepared and certified by Andrew Mantha, O.L.S., VHSBB Inc., dated July 23, 2015, as approved by the County of Essex, June 2, 2016. b) Development Charges - Third Deferral Request - 4202414 Canada Ltd. Stoney Point Retirement Home It is recommended that: 1. Council approve the third request of 4202414 Canada Ltd. to defer payment of Development Charges for its project in Stoney Point; 2. The payment schedule shall be as follows: • $94,887.99 on February 28, 2017 • $94,618.49 on April 28, 2017; and, 3. The Developments Charges shall be paid in full by the dates prescribed. If the conditions are not complied with, the applicable fees and charges shall be returned to 4202414 Canada Ltd with no further extension. 4. Interest be applied in accordance with the Tariff of Fees By-law 87-2016 on all amounts owing January 1, 2017 until paid in full. c) Exemption from Noise By-law 106-2007 LGL Limited / It is recommended that: 1. Council grant LGL LIMITED an exemption from Noise By-law 106-2007 to allow for 24 hour construction activity, the period of activity will take place over 5 nights (between 8:00 pm and 7:00 am) during the period commencing August, 2017 through to November, 2017. d) Exemption from Noise By-law for MTO It is recommended that: 1. Council grant the Ministry of Transportation (MTO) and its contractors an exemption from Noise By-law 106-2007 to allow for 24 hour construction activity during the period commencing April 1, 2017 through to October 31, 2017, to allow for the construction of two new low bay inspection facilities at the existing Highway 401 Commercial Vehicle Inspection Facility (CVIF), located on the Highway 401 Eastbound lanes. e) Tender - Vehicles (2) It is recommended that: 1. Council accept the low tender from Lally Ford, in the amount $44,492.00 (net HST) for two, 2017 Ford Focus hatchbacks
Engineering and infrastructure Services Report from administration re: a) Tender Award - Mowing Tractor It is recommended that: 1. Council award the tender for the purchase of a Mowing Tractor to Yurke Sales and Service Ltd. in the amount of $74,800 plus applicable taxes. b) Sidewalk Link between Russell Woods Road and Old Tecumseh Road. It is recommended that: 1. Council approve the construction of a sidewalk between Russell Woods Road and Old Tecumseh Road (along the east side of Elmgrove Drive) as part of the 2017 Elmgrove Phase 2 construction project. c) 2017 Additional Road Works - Silver Creek Industrial Drive and Lakeshore Road #308 It is recommended that: 1. Council approve additional 2017 capital expenditures under the Public Works budget centre for Resurfacing Silver Creek Industrial Drive - Patillo Rd to approximately 300m West at a cost not to exceed $60,000 including net HST; and 2. Approve additional 2017 capital expenditures under the Public Works budget centre for Gravel Road Conversion of Lakeshore Rd#308 from Richardson Sideroad to Gracey Sideroad at a cost not to exceed $250,000 including net HST; and 3. Authorize transfers of up to $250,000 from the Roads Lifecycle Reserve account and $60,000 from the Gravel Road Conversion Reserve account to fund these projects; and 4. Approve the deferring of Walls Road third lift application work between Puce Road and Lakeshore Road 113 and apply the $60,000 funding from the gravel conversion reserve instead towards the completion of the following roads: • Richardson Sideroad from LR#310 to LR#311, • LR#311 from Richardson SR to Tilbury/Wheatley & Romney Town line • Tilbury/Wheatley & Romney Townline from LR#311 to Kent Rd d) Goatbe Drain It is recommended that: 1. Council direct administration to sign a Section 78 request under the provincial Drainage Act to undertake improvements to the Goatbe Drain in the Community of Comber. e) Tender Award - 2017 Supply and Place Gravel Program It is recommended that: 1. Council award the tender to Rene Blain Trucking Ltd. for the 2017 Supply and Place Gravel program, as per Schedule 1, in the amount of $215,705 plus applicable taxes. 2. Council award the tender to Rene Blain Trucking Ltd. for the 2017 Stockpiling of Gravel, as per Schedule 2, in the amount of $92,500 plus applicable taxes. f) Tender Award - Public Works Pick-up Truck It is recommended that: 1. Council award the tender for the purchase of a half-ton, crew cab pickup to Rose City Ford in the total amount of $31,756.93 plus applicable taxes; and 2. That a related over-expenditure not to exceed $2,000 be approved under the 2017 Public Works budget centre. g) Rural Intersection Illumination Program-2017 It is recommended that: 1. Council approve the attached list for consideration by the County of Essex in the 2017 Rural Intersection Illumination Program. h) Tender Award - 2017 Surface Treatment Program / It is recommended that: 1. Award the tender for the 2017 Surface Treatment Program to Shepley Road Maintenance Ltd. in the total amount of $512,860.00 plus applicable taxes for conversion of Lakeshore Rd 308 (Kent Rd 1 to Gracie Sideroad), and surface treatment on Richardson Sideroad (Lk Rd 310 to Lk Rd 311), Lakeshore Rd 311 (Richardson Sideroad to Tilbury West and Romney Townline), Tilbury West and Romney Townline (Lk Rd 311 to Kent Rd 1), Lakeshore Rd 309 (Gracey Sideroad to Hwy 77) and Lakeshore Rd 310 (Hwy 77 to Rochester Townline); and 2. Authorize the Manager of Public Works Services to adjust the contract amount based on actual quantities of emulsion, aggregate and granular materials required for the completion of this project; and 3. Approve an over-expenditure not to exceed $41,200.00 for conversion of gravel road Lakeshore Road 308 (Kent Rd 1 to Gracie Sideroad) to be funded by an additional transfer from the Gravel Roads Conversion account.
Finance Services Report from administration re: a) Ontario Community Infrastructure Fund Top-Up Grant Agreement (OCIF AC3-3190) - West River Street Corridor Project and By-law 22-2017 It is recommended that Council: 1. Authorize Cheryl Horrobin, Director of Finance/Treasurer to sign the grant funding agreement (AC3-3190) with the Ontario Ministry of Agriculture, Food and Rural Affairs (OMAFRA) under the Ontario Community Infrastructure Fund (OCIF) Top-Up Application Component for up to $485,037 in funding toward the West River Street Corridor Project; and 2. Adopt and give three readings to By-law 22-2017, being a By-law to authorize execution of the referenced grant funding agreement; and 3. Approve a first-charge to the 2018 Budget for completion of the West River Street Corridor Project not to exceed $530,000, to be funded from the OCIF Top-Up Application Component funding and the Roads Lifecycle Reserve account.

Notice of Motion a) Notice of motion presented by Councillor Monk on February 14, 2017 for consideration at the March 7, 2017 meeting of Council. That: Lakeshore Council petition the Mayor and Deputy Mayor to bring forward a request to County Council seeking reimbursement of the Town of Lakeshore's portion of the $790,000 surplus funds that have been dedicated to a reserve fund and which were derived from savings due the recent county library labour dispute and that a letter be forwarded to the County of Essex Council confirming this request. b) Notice of motion presented by Councillor McKinlay on February 14, 2017 for consideration at the March 7, 2017 meeting of Council. That Council move into closed session following the regular order of business on the agenda for the March 7, 2017 meeting of Council to discuss a personal matter about an identifiable individual in accordance with the Municipal Act Section 239 2) (b).
